Usage of Trademarks and Signs
Copyrighted / Trademarked Terms
OEM shall have the temporary, free of charge, worldwide, non-exclusive right to use the following copyrighted and/or trademarked terms in their public relations, marketing and technical documents including but not limited to product markings, print documents, electronic documents, images, videos, and web pages (“OEM Documents”) in accordance with the limitations set forth in the OEM License and Service Agreement:

Orthography
OEM shall ensure that the name “embedded ocean” is always set in all lowercase and “Xentara” is always set in Start case throughout all OEM Documents.
Logo and Signet
OEM shall have the temporary, free of charge, worldwide, non-exclusive right to use the Xentara product logo and signet (as listed herein) in OEM Documents within the limitations set forth in the OEM License and Service Agreement.
This does not include the right to alter the logo or signet in any way, shape, or form except changing reproduction size (up- and downscaling) while preserving the original aspect ratio and protected zones (see below). OEM is expressly forbidden from altering any colors in the logo or signet including white areas.
- The standard versions of the logo and signet (as identified by the name suffix “-blue”) are to be used only on pure white.
- The white versions of the logo and signet (as identified by the name suffix “-white”) are reserved for use on solid or colored backgrounds darker than 50% gray.
- For OEM documents that are exclusively reproduced / displayed in black and white / grayscale, a 90% grey version of the logo and signet (as identified by the name suffix “-grey”) is provided. These are to be used only on pure white backgrounds and exclusively in monochrome documents.
- On patterned backgrounds, the standard “-blue” versions are to be used and placed on solid pure white blocking elements offering whitespace padding at least according to the logo’s and signet’s respective protected zone or larger (see below).
It is strictly prohibited to affix the logo or signet on products in any way that such use implies that embedded ocean are manufacturers or quasi manufacturers of given product. OEM is obliged to ensure that (only) OEM will be recognized as the manufacturer.
Colors
The blue color used in the Xentara logo is defined as follows:
- RGB (online media, presentation slides, video etc.): R3, G55, B195
- Web safe Hex (website content): #0337C3
- Pantone (print documents / physical products when spot colors are available): 2728 C
- CMYK (print documents / physical products when spot colors are not available): C75, M55, Y0, K24
White is always defined as pure white (RGB 255, 255, 255 | #FFFFFF).
Since the Xentara signet contains a gradient, when using the signet colors shall be used exactly as specified in the original files provided by embedded ocean. If accurate reproduction of the gradient in the provided file can not be guaranteed, an alternative version of the signet using only two colors (blue and white) can be provided as a substitute.
Protected Zones
All high resolution and vector files of the Xentara logo and signet as provided by embedded ocean contain a protected zone around the graphical element. This zone is represented as either solid white (JPG) or transparent (PNG, vector) according to file format. No other graphical or text elements are allowed to enter or cover any parts of these protected zones when used in OEM Documents.
Examples
These examples are for clarification of the above rules. Filenames and markers displaying the boundaries of the protected zones have been added for orientation purposes only and are not part of the logos themselves. Backgrounds have been added where appropriate for clarification purposes only and are not part of the respective logo. High resolution and/or vector files of the logos will be made available to OEM by embedded ocean. Any OEM documents shall be created using exclusively the high resolution or vector files provided by embedded ocean.
Screenshots et al.
OEM shall have the right to reproduce screenshots, screencasts, photographs, and video recordings of systems running the Implemented Software and/or Platform and use these for OEM Documents. If such screenshots et al. display data visualizations or user interfaces provided by embedded ocean, the picture/video shall be accompanied by the annotation “Image courtesy of embedded ocean GmbH”.
It is OEM’s responsibility to ensure that any screenshots et al. created by OEM display no proprietary data that OEM does not own reproduction rights to (e.g., machine dashboards displaying real life customer data).
Exception: This right does not include screens displaying or partially displaying any source code of or configuration files for the Implemented Software or Platform (especially, but not limited to, Data Model configuration files, Skill manifest files etc.).
embedded ocean can supply generic screenshots using randomized sample data upon request.
Self-Description
OEM shall refer to themselves as an “official Xentara OEM Partner” for the purposes of describing their relationship with embedded ocean in all OEM Documents.
